ANORDINANCE MAKING CHANGES TO CODE OF ORDINANCE TITLE XI: BUSINESS REGULATIONS

120. RENTAL REGULATIONS AND INSPECTIONS
THE CITY COUNCIL OF STEWART ORDAINS:
SECTION 1: Wordage changes to sections of Title XI: Business Regulations, Chapter 120, Rental Regulations and Inspections.
§120.02 DEFINITIONS
FAMILY MEMBERS are parent, stepparent, child, stepchild, foster child, brother, sister, grandparent or grandchild.
§120.05 APPLICATION
The owner of each rental housing unit shall make written application to the City Clerk-Treasurer for a license on a form to be supplied by the City and containing such information as necessary to administer and enforce the provisions of this Section. The legal owner of record of such rental housing unit, including any contract purchaser thereof shall make written application to the City Clerk-Treasurer for a license as provided in this Section prior to any initial occupancy, and prior to license renewal. Every applicant for a license shall assist the City in making an inspection of all portions of the building, including the notification to building occupants of the time of the inspection and requesting their cooperation during the course of the inspection.
A. Such application shall show the number of occupants for which the dwelling, dwelling unit or rooming unit is approved for. Licenses shall indicate the maximum number of occupants. A Rental Cycle shall begin on January 1st of even calendar years and expire on December 31st of odd calendar years, thus a (2) two year rental cycle.
C Renewals. A rental housing license shall expire two (2) years after the date of issuance on December 31st of the end year of the current rental cycle. Inspection of all dwellings, dwelling units or rooming units shall be required prior to the issuance of a new license. Applications for licenses shall be made in writing on forms provided by the City and accompanied by the fee amounts as established by the City Council. Such applications shall be submitted at least sixty (60) days prior to the expiration date of the license.
E. Owners submitting an application for anew rental property or apartment on or after October 1 July 1st of the end year preceding of a new rental cycle, shall be issued a rental license for the upcoming rental cycle after all requirements have been met.
§120.06 ISSUANCE OF LICENSE
It shall be unlawful for any person to conduct or operate or cause to be operated either as owner, lessee, agent or in any other capacity within the City, any rental housing as defined in this Section without having first obtained a license to do so as provided in this Section.
A. If upon completion of the inspection of the building and habitable portions thereof, it is found that the minimum requirements of this code have been met, a license shall be issued. Unless there has been a change in ownership, no inspection shall be required nor inspection fee charged for two (2) years after the issuance of a license unless a complaint of a violation has been made or the code official finds deficiencies. When ownership changes, a new license under §120.08 is required.
SECTION: 2 – Delete sections of Title XI: Business Regulations, Chapter 120. Rental Regulations and Inspections. The numbers will remain in the Code of Ordinance.
§120.07 EXPIRATION
All licenses issued under this section shall be for a period of two (2) years. The license period shall begin on January 1st and shall expire on December 31st (The current rental cycle will run from July 1. 2014 and end on December 31, 2015. After date, licensing period will start on January 1 of even years.)
§120.08 TRANSFER
No license issued under this Section shall be transferrable. A new application must be filed with the City code official. No refunds shall be made for unused periods on any license.
SECTION 3: PASSAGE AND PUBLICATION
This ordinance shall take force and be in effect from and after its passage and publication.
