TO WHOM IT MAY CONCERN:
Notice is hereby given that the Planning and Zoning Commission of Stewart will meet at the Stewart City Hall located at 551 Prior Street in the City of Stewart at 6:00 p.m. on Monday, August 13, 2018, to consider two Variance Applications from Sunrise Development, LLC. Sunrise Development, LLC is leasing the property located at 25000 70th Street, Stewart, Minnesota. The legal description of this property is AP Sec. 31-115-30, Stewart, 59.00 AC, Lot 1, Lot 2 S of Hwy and Lot 29 EX 40’ & EX 101.03’ S 120’ & EX approx. 170 x 40’ 59.00 acres.
Sunrise Development, LLC is requesting this variance of: 0ft fence setback variance from wetlands to ensure site security can be maintained per the National Electric Safety Code during construction and operations. Applicant has received both Federal and County approval for the placement of the solar facility and associated fencing in the subject wetland areas. According to the City of Stewart’s Zoning Ordinance:
§ 151.028 RURAL RESIDENTIAL AND AGRICULTURAL DISTRICT
(1) Conditional use permit standards for the Rural Residential and Agriculture Single-Family Residential District.
(3) Specific standards. In addition to the standards specified in division (2), no conditional use permit shall be granted unless the City Council determines that all of the specific standards contained in this division will be met.
(d) Solar Energy Conversion Farms
(1) The applicant must submit a site development plan, drawn to scale, that includes:
(b) Wetlands as delineated by a professional wetland scientist
(c) Security fence setbacks of at least 30 feet from the parcel boundaries, 100 feet from the centerline of any public road, 2 feet from delineated wetland edges, and 250 feet from the nearest house other than that of the property owner.
Such persons as desired to be heard with reference to this variance application will be heard at this meeting.
