McLeod County deputy will not face charges in NYA shooting
The Carver County Attorney's office announced today (Friday) that it will not file any criminal charges against McLeod County Deputy Matthew Wyatt, who shot a man in the arm outside the Kwik Trip in Norwood Young America April 17.
A statement from the attorney's office said that "after a thorough and independent investigation, it became clear that no reasonable person could conclude under these circumstances the police officer was not justified under Minnesoa law in shooting the individual."
The incident in question involved wyatt and 23-year-old Michael Montgomery. It occured about 2:40 a.m. April 17 when Wyatt, who had stopped at the station on his way home, tried to keep Montgomery from allegedly drinking and driving. A physical altercation ensued and Wyatt shot Montgomery once through the arm. Wyatt suffered a concussion and other injuries from the altercation.
Montgomery is facing a felony charge of assault on the deputy and a misdemeanor charge of driving under the influence. His first court appearance will be Sept. 4 in Carver County District Court in Chaska.
