Panther wrestlers defeat Dassel-Cokato, Litchfield
The 2006-07 Panthers defeated DC, 30-25, on Feb. 9 in Glencoe. Four nights later in Litchfield, they upset the Dragons, 25-22, in a quarterfinal of the Section 5 (Class AA) team tournament. Now, Wurm’s seventh squad of Panthers has scored a Chargers/Dragons double, too. Indeed, Wurm’s 2012-13 team opened its Wright County Conference dual schedule with victories of 42-30 over Dassel-Cokato and 53-14 over host Litchfield. Panthers top N. Ulm, too; off to a 3-1 start
By Lee Ostrom Sports Editor he Glencoe-Silver Lake boys’ basketball team opened its home court schedule with a show of fun entertainment last week. Thursday evening, the Panthers edged Hutchinson, 65-64, in an overtime thriller. Saturday afternoon, they dazzled New Ulm with a 31-6 run of points, and ultimately scored a 7767 decision. As a result, GSL is off to a 3-1 start — its lone loss being by a 6457 score at traditional Class AAAA power Bloomington Jefferson last Tuesday, Dec. 11. Last week’s main attraction was supposed to be the Hutch game, and the two teams did not disappoint. After GSL opened on a 14-3 run, the Tigers responded with a run of their own — highlighted by three straight triples from reserve guard Riley Steenhoek. Hutch led by five, when GSL sophomore Keaton Anderson drained a three-pointer that narrowed the Tiger lead to 36-34 at halftime. The second half, including the 4minute overtime stanza, was remarkably tight. Hutchinson’s largest lead was a single four-pointer, at 40-36. Four points was GSL’s longest margin, too — at 52-48 and 60-56. It was Hutch guard Alec Nassirzadeh’s trey that tied the score at 56-all with 1:21 of regulation time remaining. Each side had two empty possessions after that; thus, sending the game to overtime. GSL struck first on deuces by seniors Reed Dunbar and Travis Rothstein. But Nassirzadeh knocked down another trey, before Dunbar answered from the shooting team’s left corner. A deuce by Steenhoek, a GSL turnover, and a steal-and-solo layup by Rothstein gave the Panthers a 6461 lead with 34 seconds to go. But nine seconds later, Steenhoek pulled the trigger on a tying three. It was good. With 12.9 seconds left, Panthers guard Ethan Maass knocked down

Plenty of time for Hutchinson — which had worked over Panther rebounders on the GSL defensive board throughout the second half — to get up four attemps at a go-head basket. Not one was on target. Finally, Maass — a much decorated football safety — knocked the ball off the board to himself. The defensive board being the final play in GSL’s victory. “It was pretty much like football out there,” Maass said. Maass, who led the Panthers in points (20) and assists (6), also took down nine boards. “Ethan really ... prides himself on being a tough rebounder,” head coach Robb DeCorsey said. Despite the game’s physical play and high intensity, Anderson (18 points) shot with touch. The lefty was 8-for-10 from the field, including 2-for-3 from beyond the arc. He also took down nine boards. Senior big Trenton Draeger was 3-for-3 before leaving the game with a lower thigh bruise. Dunbar, who DeCorsey lauded for holding the Panthers together at crunch time, was 5-for-10

Girls keep heads high despite 0-6 start

The GSL girls’ basketball team collected two more losses last week. The girls fell 59-45 at home to New Prague on Tuesday and 55-42 on the road at Annandale on Friday. As a result, the Panthers record dropped to 0-6. So I asked head coach Cullen Ober if he can provide some perspective. He said improvements are occurring, particularly on the defensive end. His captains assure him that every team member continues to hold her head high. And the coach is pleased to be in a one-game week (Mayer Lutheran visits Thursday), allowing for an extra day of practice. Clearly, GSL has not scheduled any patsies so far. And there are encouraging developments. For one thing, both returning regulars are playing well. All-WCC big Clarissa Ober, a 6-1 senior, had 17 points, 10 rebounds, four blocked shots and three assists against New Prague; then 14 points, 10 rebounds and four assists at Annandale. On course to graduate with her name possibly on all six of her school’s top 10 lists (for points, rebounds, assists, steals, blocked shots and 3-point field goals), Ober entered this season already first in blocked shots (246). She stood second in rebounds and fifth in points. She has moved up to fourth in points — now trailing only Jalissa Huepenbecker, Hali Haukos and leader Brittany Thiesfeld, Junior big Stephanie Klockmann also showed her experience with 11 points and 13 rebounds against New Prague. She only scored three points at Annandale, but took down 11 boards. Fellow 11th-grader Samantha Lange stepped up with 10 points. Here’s hoping that better days are ahead for the GSL girls.

He noted that in the Litchfield match, ninth-graders Aaron Donnay (10-4 decision at 113) and Nick Brejle (10-7 decision at 160) defeated opponents who had pinned them last winter. Each was aggressive from the start and tallied an initial takedown. The Panthers’ overall record in duals is 4-1, following their second-place showing at last Saturday’s tournament in Richfield. Seventh a year ago, GSL/LP advanced to this year’s championship match with victories over Roseville Area, 66-15, and Eastview, 50-27. The team title, however, went to Lakeville North, 47-24. Panthers enjoying big Saturdays included the following: • Jewett, who won twice by fall and once by technical fall at 106 pounds. A memorial of granite, marble or bronze that does not extend above the surface of the lawn and is placed at the foot of the burial plot § 94.02 ESTABLISHMENT. A cemetery has been established and is continued upon land owned and designated by the City of Stewart, Minnesota, as Round Grove Lake Cemetery. The plats of the cemetery filed with the county recorder in McLeod County, Minnesota, are adopted as the official plat of the cemetery. No person shall lay out or establish any cemetery, or use any lot of land within this City for the burial of dead except in the Round Grove Lake Cemetery, or some other tract of land duly designated by the City as a cemetery. § 94.03 SALE OF LOTS. The prices of cemetery lots and services will be set by the Fee Schedule adopted by the City Council. Any person paying for a lot is entitled to a license agreement conveying the lot. a license agreement conveying a lot gives the purchaser only the right of burial therein and shall be considered as a license that restricts the use to burial purposes. § 94.04 CONDITIONS OF LOT PURCHASE. All lot agreements are subject to reasonable rules and regulations as the City Council may adopt relative to the use of the cemetery. No lot shall be used for any purpose other than the burial of human remains and the placing of memorials as permitted by this ordinance or any additional regulation that the City Council may adopt. § 94.05 HANDLING OF FUNDS. All money received from the sale of lots and other services must be paid to the City Treasurer. No lot agreement to any cemetery lot shall be issued, nor any cemetery service performed until payment has been received or a payment plan has been agreed upon. § 94.06 BURIAL PERMITS. A burial permit from a funeral home or State Registrar of Vital Statistics, or a disposition permit, or death certificate as prescribed by a State Department of Health shall be filed with the City within one week of a burial. § 94.07 INTERMENTS. All excavations shall be made under the supervision of the cemetery superintendent or his agents. At least twenty-four (24) hour notice shall be given, and the type of burial and the location shall be specified. § 94.08 BURIAL VAULTS. All caskets, traditional or cremation, must be encased in a permanent type burial case or vault delivered and installed by a bonded and insured burial vault provider. Fiberglass vaults are prohibited. § 94.09 DISINTERMENT AND REMOVAL. Disinterment and re-interment must comply with Minnesota Statute Section 149A.96. Before any grave may be opened, written permission of the lot owner shall be filed with the City Clerk, a permit from the county health officer or licensed mortician shall be secured and presented, and the required fees paid. If the casket is re-interred in another cemetery the lot owner or his/her representative will pay one open/close fee. If the casket is re-interred in the Round Lake Cemetery a fee twice the open/close fee will be paid. This provision does not apply
when disinterment is ordered by a duly authorized public authority. (A) Removal of a body by the heirs so that the lot may be sold for profit to themselves, or removal contrary to the expressed or implied with of the original lot owner is forbidden. (B) A body may be removed from its original lot to a larger or better lot in the cemetery when there has been an exchange or purchase for that purpose. (C) The City shall assume no liability for damage to any casket or burial case in making the disinterment and removal. § 94.10 MONUMENTS and MARKERS. (A) All monuments and markers shall be placed as shown as directed by the cemetery superintendent. (B) The masonry, granite or marble foundation base pad of a monument or marker shall not exceed 2’ by 5’ on a double lot or 2’ by 3’ on a lot. All monuments and markers shall be slightly smaller than the foundation base pad. (C) All monuments and markers shall be placed at the head end of the grave and must be attached to the base pad to ensure no movement. (D) All foot markers shall be placed at the foot end of the grave and must be placed on the actual burial plot not in the 2’ space between graves. (E) All monuments shall be set level. (F) Monuments and markers must be constructed of granite, marble, bronze, wrought iron or boulder (stone) material. § 94.11 FOUNDATIONS. All monuments and markers shall be placed on foundations of solid masonry, granite or marble. The top of all foundations shall not be higher than two inches below the established grade. § 94.12 INSTALLATION OF MONUMENTS AND MARKERS. No monument or marker may be placed without the supervision of the cemetery superintendent or his agent. Monuments and markers cannot be placed after November 20. Monuments and markers shall be placed during city work hours 7:00 a.m. to 3:30 p.m. Monday through Friday. Monuments and markers placed after regular city work hours will be subject to a fee equal to the overtime wages and benefits of the supervising employee. § 94.13 DECORATION OF LOTS. (A) Plants and flowers may be placed permanently on cemetery lots when in an urn that is part of the monument or marker. Plans and flowers placed in other containers shall be permitted as long as the item does not impede the maintenance of the cemetery; if such items are placed, the City may remove them and the City shall not be responsible for damaged or lost items. (B) No trees, shrubs or vines may be planted, nor may fences be erected. The City reserves the right to remove any tree, shrub, vine, plant, or flower that may become unsightly, dangerous, or not in keeping with the landscape design of the cemetery. The City shall not be responsible for damage, lost, or misplaced flower containers. (C) The placing of boxes, shells, toys, metal designs, ornaments, chairs, settees, glass, wood, or iron cases, and similar articles upon lots shall be permitted as long as the item does not impede the maintenance of the cemetery; if such items are placed, the City may remove them and the City shall not be responsible for damaged or lost items. (D) All objects not described above, including balloons banners, food and beverages, knick knacks, shepherd hooks, solar lights and lanterns, stuffed animals, wind chines, windmills, windsocks, and statuary not incorporated into a monument, and similar articles upon lots shall be permitted as long as the item does not impede the maintenance of the cemetery; if such items are placed, the City may remove them and the City shall not be responsible for damaged or lost items. (E) The City reserved the right to remove all monuments, markers, flowers, plants, trees, decorations, or other similar things without liability to the owner whenever any of these objects become unsafe. § 94.99 PENALTY. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.00. In Summary Brownton City Council Tuesday, December 4, 2012 7:00 p.m. Mayor Carrigan called the regular City Council meeting to order with the Pledge of Allegiance. Members present: Douglas Block, Brian Dressel, Charles Warner and Curtis Carrigan, Norman Schwarze. Consent agenda reviewed. Motion by Dressel, second by Schwarze and carried to approve the consent agenda as follows: Approve minutes of regular meeting 11/7/2012. Approve minutes of special meeting 11/13/2012. Approve the Treasurer’s report. Approve payment of the claims and payroll. RESOLUTION APPROVING 2013 FINAL BUDGET AND TAX LEVY Be it Resolved by the City Council of the City of Brownton, County of McLeod, Minnesota to approve the 2013 proposed budget and that the following sums of money be levied collectible 2013 upon taxable property in the City of Brownton for the following purposes: General Fund 227,403. Bond Purposes 2000 Streets/ Utility Bond 73,714. 2009 Street/ Utility Bond 23,750. 2011 Facility Redevelopment Bond 63,050. Total Levy 387,917. Be it Further Resolved that the City Clerk is hereby instructed to transmit a copy of this resolution to the McLeod County Auditor. Chief Morris Gasow approached the council to report on the excess purchase and cost of various products. Motion by Block, second by Schwarze and carried to accept payment from the Fire Relief Association Fund Raising account in the amount of $8,600.00. Motion by Block, second by Schwarze and carried to adjust the Consent Agenda to include the Fire Department Chief wages. City Engineer, Rodeberg presented an update on the Natural Gas Utility Project. Be It Resolved by the Brownton
City Council to approve the Agreement for Professional Services between the City of Brownton and S.E.H. Inc. for Engineering Services using the hourly basis option, for the Natural Gas Utility Project, and to authorize the signature thereof. Flood Mitigation Project was discussed and correspondence will be sent out to the property owners with individual information and a meeting to address any questions will be scheduled. Public Works Director, Streich presented monthly report. Discussed electrical meters, lift station damage as finalized to be billed to McLeod County Highway Department. Ken Bauer presented monthly police report, including participation in the TZD (Towards Zero Deaths) program. Discussed the pet ordinance, pet limit and a possible kennel option. The decision was to send out the letter to pet owners in violation and to enforce the Ordinance as written. Be It Resolved by the Brownton City Council to appoint Ken Bauer as permanent part-time Police Chief for the Brownton Police Department. Civic Center issues discussed. Painting of the floor in the southeast room approved. City Clerk presented employee salary information. Discussion held. Be It Resolved by the Brownton City Council to increase the salary for Deputy City Clerk Ella Kruse to $15.00 per hour. Be It Resolved by the City Council to approve a 5% salary increase for the following employees: Mark Streich, Chad Draeger, Cynthia Lindeman, Barb Mathwig, Deb Zellmann, Charles Schrader, emergency maintenance and part-time patrol officers effective January 1, 2013. RESOLUTION APPROVING 2013 LIQUOR LICENSE Whereas, the City Council has received a request for a 2013 Liquor license, Now Therefore Be It Resolved by the Brownton City Council to approve an On-Sale Liquor License and Sunday Liquor License for 2013 in the name of Brownton Place Inc. dba The Brownton Bar & Grill, for the period of one year from the 1st day of January, 2013, and to authorize the signature thereof, contingent upon receipt of Certificate of Insurance. Be it further resolved to authorize the signature of the State Off Sale Liquor License. Motion by Dressel, second by Schwarze and carried to reschedule the regular City Council meeting from January 1 to Tuesday, January 8, 2013. Council member Schwarze presented a plaque to Mayor Carrigan in acknowledgement of his 10 years of service as Mayor of the City of Brownton. Sheriff’s Report
On Tuesday, Dec. 11, at 7:08 a.m., the sheriff’s office responded to a vehicle in the ditch in the area of Highway 22 and 125th Street, northwest of Glencoe. There was no one around. At 3:56 p.m., Tuesday, the sheriff’s office assisted the Hutchinson Police with an accident in the area of School Road Northwest and Highway 7 in Hutchinson. There were no injuries. The sheriff’s office assisted the Glencoe Police and the Glencoe Ambulance with a medical on Armstrong Avenue in Glencoe at 11:12 p.m., Tuesday. Upon arrival, it was determined the individual had died. The death investigator and a local funeral home were contacted. On Wednesday, Dec. 12, at 12:49 a.m., the sheriff’s office assisted the Hutchinson Police with a fight at a business on Main Street North in Hutchinson. The sheriff’s office responded to a report of a car-deer accident on Leaf Avenue, southeast of Brownton, at 6:51 a.m., Wednesday. There were no injuries. At 8:45 a.m., Wednesday, the sheriff’s office, Silver Lake First Responders and Silver Lake Ambulance responded to a medical at a residence on Silver Avenue in Silver Lake. The patient was not taken to a hospital. The sheriff’s office, Stewart First Responders and the Buffalo Lake Ambulance responded to a medical at a business on South Street in Stewart at 9:57 a.m., Wednesday. The individual was taken by ambulance to the Glencoe hospital. At 12:58 p.m., Wednesday, the sheriff’s office assisted the Minnesota State Patrol with a two-vehicle accident in the area of Major Avenue and Highway 7, east of Hutchinson. Also responding were the Hutchinson Fire Department and the Allina Ambulance. One individual was transported by ambulance to the Hutchinson hospital. Quincy Sylvester Taylor, 32, of Hutchinson, was arrested at 5:57 p.m., Wednesday, on a Carver County warrant at an address on High Street Northeast in Hutchinson. Taylor was transported to Carver County. At 11:19 p.m., Wednesday, the sheriff’s office responded to call of a vehicle stuck at the Lake Marion boat access on Highway 15, northwest of Brownton. The vehicle was towed out. On Thursday, Dec. 13, at 4:39 p.m., the sheriff’s office assisted the Silver Lake Police in looking for a vehicle involved in hit-andrun accident in Silver Lake that occurred in the area of Grove Avenue Northeast and Highway 7 in Silver Lake. The deputy was unable to locate the vehicle. At 7:08 p.m., Thursday, the sheriff’s office received a 9-1-1 call about a power outage at an address on 225th Street, north of Silver Lake. At 7:16 p.m., another 9-1-1 call was received about a power outage at an address on Eagle Avenue, west of Winsted. On Friday, Dec. 14, at 5:09 a.m., the sheriff’s office assisted the Glencoe Police and the Glencoe Ambulance with a medical on Hennepin Avenue in Glencoe. The individual was transported to the Glencoe hospital by ambulance. Also on Friday, at 8:26 a.m., the sheriff’s office responded to a vehicle in the ditch on 230th Street, north of Silver Lake. The deputy provided lights for the tow company and the vehicle was removed from the ditch. The sheriff’s office assisted the Glencoe Police with an accident in the area of Highway 212 and Morningside Drive in Glencoe at 4:26 p.m., Friday. Also responding was the Glencoe Ambulance. The sheriff’s office conducted tobacco compliance check at a business on South Street in Stewart. A citation was given to an employee for selling tobacco to a child. The sheriff’s office conducted another tobacco compliance check at a business on Main Street West in Silver Lake at 8:04 a.m., Friday. A citation was given to an employee for selling tobacco to a child. On Saturday, Dec. 15, at 2:13 a.m., the sheriff’s office assisted Minnesota State Patrol with recycle bins on Highway 22, southeast of Hutchinson. The bins were removed from the roadway. At 1:43 p.m., Saturday, the sheriff’s office assisted the Brownton Police and the Brownton Fire Department with a gas leak in the city of Brownton. The gas leak was fixed. Also on Saturday, at 2:05 p.m., the sheriff’s office responded to a vehicle in the ditch in the area of Major Avenue and 200th Street, east of Hutchinson. The vehicle was towed. At 8:41 p.m., Saturday, the sheriff’s office assisted the Minnesota State Patrol with a vehicle in the ditch on Highway 22, south of Hutchinson. The vehicle was towed out of the ditch. The sheriff’s office assisted the Glencoe Police and the Glencoe Ambulance with a medical on Ford Avenue in Glencoe at 9:23 p.m., Saturday. The individual was taken to the Glencoe hospital. On Sunday, Dec. 16, at 12:31 a.m., a deputy checked on a vehicle in the ditch in the area of Highway 7 and Park Avenue Northwest in Silver Lake. As a result, the driver, Joseph William Farniok, 23, of Watertown, was arrested on probable cause charge of driving while intoxicated and brought to the McLeod County Jail in Glencoe. At 6:33 a.m., Sunday, the sheriff’s office responded to report of a car in the ditch in the area of Vale Avenue and 180th Street, west of Hutchinson. The sheriff’s office assisted Glencoe Police with a domestic disturbance at a residence on 10th Street in Glencoe at 9:21 a.m., Sunday. At 10:25 a.m., Sunday, the sheriff’s office assisted the Silver Lake Police, Silver Lake First Responders and the Silver Lake Ambulance with a medical on Main Street West in Silver Lake. The individual was taken to the Glencoe hospital by ambulance. The sheriff’s office assisted the Silver Lake Police, Silver Lake First Responders and Silver Lake Ambulance with a medical on Main Street East in Silver Lake at 2:24 p.m., Sunday. The individual was taken to a hospital by ambulance. At 9:38 p.m., Sunday, the sheriff’s office assisted the Minnesota State Patrol with a driving complaint in the area of Highway 212 and Zebra Avenue, east of Plato. The deputy stopped the vehicle and issued a verbal warning. On Monday, Dec. 17, at 8:29 a.m., the sheriff’s office found a damaged road sign on Koniska Street near Koala Road, north of Glencoe. The deputy cleared with a report. At 11:38 a.m., Monday, the sheriff’s office received reports of suicidal threats from an individual in the Glencoe area. A deputy located the individual on Jet Avenue, north of Silver Lake. The individual was transported to the Hutchinson Emergency Room. The sheriff’s office served an arrest warrant on an individual at a residence on County Road 2, north of Glencoe, at 3:38 p.m., Monday. Roger Alen Gutzke, 66, of Glencoe, was arrested on a McLeod County warrant and transported to the McLeod County Jail. By Sharon Haggenmiller Sibley County Museum curator Tis the season to be jolly, the snow is glistening and the Sibley County Historical Museum is decorated for Christmas. The public is invited to attend the party from 1 p.m. to 5 p.m., Sunday, Dec. 30. Programs are planned for 2 p.m., 3 p.m. and 4 p.m. Entertainment will be provided by the Royalty of Henderson and Gaylord, a sing-along, piano music, an explanation of a few of the precious gifts that have been donated to the museum over the years. Refreshments will be served with room to sit and visit. The museum is located along State Highway 19, at the west edge of Henderson in the former A.F. Poehler house Be sure to stop by and celebrate with us! The decorating theme this year is simply — gifts. SCHS receives gifts year round in the form of artifacts, monetary donations and lots of help from volunteers. They are eager to share the gift of knowledge about early Sibley County history to everyone who comes to visit. The Sibley County Museum would not be able to survive without these gifts. I would like to express our appreciation of the Sibley County Board of CommisOutpatient Youth Program
sioners, who approve annual support, area newspaper editors, who include the news releases every month, which inform the general public of our activities and especially to the editors who help by publishing the unknown photos in our collection, from the former Ostrom Photo Studio at Winthrop. State Patrol
A two-vehicle crash was reported at 12:59 p.m., Wednesday, Dec. 12, on Highway 7 near Major Avenue. Involved were a 2004 Jeep Grand Cherokee driven by Ashley J. Ardolf, 27, of Lester Prairie, and a 2005 Ford Focus driven by Gwendolyn F. Schleif, 61, of Hutchinson. Ardolf suffered minor injuries; Schleif was not injured. Both were eastbound on Highway 7 when another vehicle, pulling a hay wagon, was traveling slowly, backing up traffic. Schleif hit the brakes and collided with the Ardolf vehicle, the State Patrol reported.

Police Report
Police issued three “snowbird” ordinance citations early Tuesday morning, Dec. 11. Gary Schreifels, city public works director, reported finding dead geese around the holding pond at 19th Street and Louden Avenue on Tuesday morning. He was concerned someone was shooting them. Several hours later, an officer spoke with property owners in the area, who also found dead geese. There are no suspects at this time. Eleven dead geese were found. An elderly female was transported by ambulance after reporting having low blood pressure at 8:28 p.m., Tuesday. The woman lived on 16th Street. Police were called to a home on Armstrong Avenue for a medical at 11:32 p.m. and found a person had died. The body was turned over to the Arlington funeral home. Police were called to assist on a medical at the jail at 5:19 p.m., Wednesday. A person was taken by ambulance for treatment of a cut on the head and for dizziness. Just before midnight on Wednesday, two juveniles were cited for underage drinking in the 700 block of Morningside Drive. A woman with a broken hip was transported from her Greeley Avenue residence by ambulance at 7:04 a.m., Thursday. Another medical call was received at 9:56 a.m. after a person gave blood and returned to work, and then passed out. The person was transported to the hospital emergency room by ambulance. A theft of a cellphone was reported by a resident in the 700 block of 10th Street at 1:06 p.m., Thursday. A 10th Street resident was transported by ambulance to the hospital emergency room after suffering an asthma attack at 1:31 p.m., Thursday. Two medicals were called in on Friday morning. The first was at 5:09 a.m. from a residence on Hennepin Avenue and involved a 93-year-old man with lung problems. He was transported by ambulance to the hospital emergency room. The other occurred at 11:47 a.m. and involved a possible stroke victim. Police assisted the ambulance crew at the residence in the 700 block of 18th Street. Four “snowbird” parking tickets were issued Saturday morning. Another medical was called in at 10:09 a.m., Saturday from a residence on 14th Street. A person had fallen the night before and was discovered by a friend. The person was taken by ambulance to the hospital emergency room. Two more “snowbird” tickets were issued early Sunday morning A medical call was received at 3:44 p.m., Sunday, from a residence on 15th Street. A woman had a shortness of breath and was hyper ventilating. She was transported by ambulance to the hospital emeregncy room.

Gutzke, county reach settlement over his treatment while in custody
A settlement has been reached in a civil lawsuit brought by rural Glencoe resident Roger Gutzke against McLeod County, but “any transcript of the terms of settlement is confidential and shall be SEALED, with access being allowed only to the parties and their counsel,” according to U.S. District Court documents. Gutzke filed the lawsuit in June against Sheriff Scott Rehmann, Chief Deputy Sheriff Tim Langenfeld, Jail Administrator Katharine Jones, Sergeant Sheryle Jannusch, deputies “John Doe” and “Jane Doe” and McLeod County, alleging he was mistreated while incarcerated at the McLeod County Jail, seeking in excess of $75,000 for permanent injuries, and in excess of $300,000 in punitive damages. According to the complaint, Gutzke was committed to the McLeod County Jail on Jan. 17, 2012, “due to his nondisclosure of the location of a skid steer sought by a creditor.” The complaint goes on to say that Gutzke suffers from a wide range of medical ailments, including diabetes, asthma, early-stage Parkinson’s, hypertension, coronary artery disease, depression, adjustment disorder and symptoms from exposure to Agent Orange during the Vietnam War. The complaint alleges that mismanagement of Gutzke’s medications resulted in a “gradual breakdown of his state mind,” which was evidenced by unsanitary “but non-threatening” acts, and he eventually was referred for psychiatric evaluation. The complaint said that Gutzke “did not cooperate with the departure” from the facility, and had to be moved by wheelchair to the transport vehicle, “where he then spit several times.” The complaint goes on to say that Gutzke was “silent and immobile” upon arrival at the jail, but was then placed in an emergency restraint chair “that is designed to temporarily immobilize an inmate ….” The complaint asserts that Gutzke was left in the chair for a total of 30.7 hours in a 33.15-hour time period, during which he “suffered contusions, abrasion and some scarring on his wrists,” as well as numbness and affronts to his personal dignity. In a response to the lawsuit, the defendants “deny each and every thing, matter and particular alleged in Plaintiff’s Complaint;” that “their conduct was lawful, constitutional and proper and were acting in their official capacities as corrections officers and law enforcement officers with McLeod County.” Furthermore, the defendants “deny failing to adequately train employees, deny deliberate indifference to the rights of citizens, and deny tolerating, permitting, failing to correct, acquiescing in or ratifying restraint chair usage that violated Plaintiff’s right to be free from excessive force or unreasonable seizures ….” The settlement was reached Oct. 31 after a four-hour conference in U.S. District Court.

After nearly nine months of investigation, the National Transportation Safety Board (NTSB) released its official report on the cause of an airplace crash last March 21 that claimed the lives of three people. The plane
crashed in a farm field about five miles north and east of Glencoe. The report indicated the plane broke up in mid-air before crashing.
Fatal crash: A mid-air breakup
By Rich Glennie Editor The probable cause of the March 21 fatal airplane crash just north of Glencoe was overload failure that caused the Beech 35 to crash in a farm field, killing all three people aboard. That was the ruling released Dec. 11 by the National Transportation Safety Board (NTSB). According to the FFA investigation, pilot Stuart Douglas Dahlberg, 52, of Brooklyn Center, was flying east to west when witnesses “heard a loud crack and then the impact of the airplane with the ground. Based upon witness statements and reported weather conditions, the flight encountered instrument meteorological conditions.” The report said Dahlberg, a non-instrument-rated private pilot was “conducting the accident flight under visual flight rules without a flight plan.” The report continued: “The distribution of the wreckage was consistent with an inflight breakup starting with the separation of the left wing followed by separation of the empennage (tail assembly of the airplane). “All fracture surfaces were consistent with overload failure. An examination of the remaining systems revealed no anomolies. There was no record of the pilot receiving a preflight weather briefing from a recorded source,” the report stated. Therefore, the report stated, the NTSB determines the probable cause(s) of this accident to be: “The non-instrument-rated pilot’s continued flight into instrument meteorological conditions, which resulted in the design limits of the airplane being exceeded and an in-flight breakup.” The accident killed not only Dahlberg, but his wife, Ivelisse Suarez Morillo, 36, and Dahlberg’s mother, Mae Elaine Dahlberg, 76, of St. Cloud. Also killed were several dogs in the plane. According to the NTSB report, the accident occurred at 11:12 a.m., March 21, about five miles north of Glencoe. A post-impact fire ensued. Glencoe firefighters and area law enforcement personnel were on the scene, along County Road 15 near 150th Street, minutes after the crash was reported. The flight originated from Crystal Airport (KMIC), Minneapolis, and was en route to Craig, Colo. Several witnesses in the area reported hearing an airplane flying low and hearing a loud snap or pop. One witness heard a second explosion as the airplane struck the ground. These witnesses described the weather as low overcast skies with limited visibility due to light fog and mist. There was no radar data available from the Federal Aviation Administration for the accident flight. Steven Dahlberg, the pilot, held a private pilot certificate with a single-engine land rating. He was issued a third class airman medical certificate on Oct. 28, 2011. The certificate contained the limitation “must wear corrective lenses.” At the time of application for his airman medical certificate, the pilot reported a total time of 250 hours, and no flight time within the preceding six months. A review of the maintenance records of the Beech 35 indicated that an annual inspection had been completed on March 22, 2011. The NTSB report indicated the wreckage was scattered over 900 feet between two plowed fields divided by a field service road. The northern field was a dormant cornfield and the southern field was a dormant soybean field. The Midwest Medical Examiner’s Office performed the autopsy on the pilot on March 22, 2012. The autopsy concluded that the cause of death was multiple blunt force injuries, and the report listed the specific injuries. The wreckage was recovered and relocated to a hangar in Minneapolis where federal investigators worked to determine the cause.

The City of Glencoe’s solid waste collection services will change beginning the week of January 1, 2013. The goal is to increase recycling participation, promote cleaner streets and neighborhoods.
Every single-family home will receive a new 64-gallon recycle cart. Every home will continue to have trash collection weekly; with recycling every other week on Monday (see city map). Residents may request additional recycling carts from Waste Management.
